Nov 1, 2022: Safe Harbor Warning Regulation for Exposures to Acrylamide from Food

On October 26, 2022, the Office of Administrative Law approved the Office of Environmental Health Hazard Assessment’s proposal to amend Title 27, California Code of Regulations by adding new subsection 25607.2(b) to Section 25607.2. The regulation will be effective on January 1, 2023.

On September 1, 2022, the Office of Administrative Law approved the Office of Environmental Health Hazard Assessment’s proposal to amend Title 27, California Code of Regulations by adopting Sections 25607.48 and 25607.49

Aug 8, 2022: Adoption of Regulations: Warnings for Cannabis (Marijuana) Smoke and Delta-9-Tetrahydrocannabinol (Delta-9-THC) Exposure

On August 4, 2022, the Office of Administrative Law approved amendments to Title 27, California Code of Regulations by adopting Sections 25697.38 through 24607.47 into Title 27 of the California Code of Regulations. The new sections address exposures to listed cannabis (marijuana) smoke and Delta-9-THC.

Jun 21, 2022: Proposition 65: No Significant Risk Level for 1,3-Dichloropropene (1,3-D)

The Office of Environmental Health Hazard Assessment (OEHHA) has adopted an NSRL of 3.7 micrograms per day for exposures to 1,3-dichloropropene by the oral and inhalation routes.

May 20, 2022: May 2022 Status Update for Clear and Reasonable Warnings - Short Form: Completion of Proposed Rulemaking

The proposed rulemaking to amend the regulation related to short-form Proposition 65 warnings was initially noticed in the California Regulatory Notice Register in January 2021. OEHHA has allowed the rulemaking to lapse as provided for under the Administrative Procedure Act OEHHA intends to restart the rulemaking process on the short-form with a new regulatory proposal, informed by comments on the previous proposal, in the next several weeks.

Mar 4, 2022: Request For Relevant Information On The Reproductive Toxicity Of Bisphenol S (BPS)

The California Environmental Protection Agency’s Office of Environmental Health Hazard Assessment has selected bisphenol S (BPS) for the Developmental and Reproductive Toxicant Identification Committee  review for possible listing under Proposition 65 and is soliciting information relevant to the assessment of its reproductive toxicity.

Feb 25, 2022: Notice to Interested Parties Chemical Listed Effective February 25, 2022 As Known to the State of California to Cause Cancer: Perfluorooctanoic Acid

The California Environmental Protection Agency’s Office of Environmental Health Hazard Assessment (OEHHA) intends to list perfluorooctanoic acid (PFOA) (CAS RN 335-67-1) as known to the state to cause cancer under the Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65).  This action is being proposed pursuant to the “Authoritative Bodies” listing mechanism.

Effective December 31, 2021, the Office of Environmental Health Hazard Assessment (OEHHA) is adding Perfluorononanoic acid (PFNA) and its salts to the list of chemicals known to the state to cause reproductive toxicity for purposes of the Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65).

Effective December 17, 2021, the Office of Environmental Health Hazard Assessment (OEHHA) is adding tetrahydrofuran (CAS No. 109-99-9), 2-ethylhexyl acrylate (CAS No. 103-11-7), methyl acrylate (CAS No. 96-33-3), and trimethylolpropane triacrylate, technical grade to the list of chemicals known to the State of California to cause cancer for purposes of Proposition 65

Nov 5, 2021: Announcement of the Developmental and Reproductive Toxicant Identification Committee Meeting Scheduled for December 14, 2021; Notice of Availability of Hazard Identification Materials for Perfluorononanoic Acid and Perfluorodecanoic Acid and Their Salts

The California Environmental Protection Agency’s Office of Environmental Health Hazard Assessment will convene a meeting of the Developmental and Reproductive Toxicant Identification Committee for possible listing of perfluorononanoic acid (PFNA) and its salts, and perfluorodecanoic acid and its salts, under the Safe Drinking Water and Toxic Enforcement Act of 1986. This will also opening a 45-day public comment period on the hazard identification document for these chemicals.

Oct 22, 2021: Notice of Proposed Rulemaking Amendment to Section 25705 Specific Regulatory Levels Posing No Significant Risk: 1,3-Dichloropropene

Notice is hereby given that the Office of Environmental Health Hazard Assessment proposes to adopt Proposition 65 No Significant Risk Levels for 1,3-dichloropropene by amending Title 27, California Code of Regulations, section 25705(b). The proposed NSRLs for oral and inhalation exposures to 1,3-dichloropropene are 3.7 micrograms per day.
