Meeting Synopsis from the Developmental and Reproductive Toxicant Identification Committee Meeting Held on December 14, 2021

A meeting of the Proposition 65[1] Developmental and Reproductive Toxicant Identification Committee (DARTIC)[2] was held via webcast and webinar on December 14, 2021. The main agenda items were committee consideration of perfluorononanoic acid (PFNA) and its salts and perfluorodecanoic acid (PFDA) and its salts as known to the state to cause reproductive toxicity (based on male reproductive toxicity).

SUMMARY OF THE LISTING DECISIONS

OEHHA staff gave a summary presentation on the hazard identification document on PFNA and its salts, DARTIC members discussed the evidence, and members of the public provided oral comments. After their deliberations, the DARTIC determined (6 yes, 2 no) that perfluorononanoic acid (PFNA) and its salts were clearly shown through scientifically valid testing according to generally accepted principles to cause reproductive toxicity (based on male reproductive toxicity). (These chemicals were therefore added to the Proposition 65 list of chemicals, effective December 31, 2021. The warning requirement for significant exposures to these chemicals will take effect on December 31, 2022.)

With 5 noes and three abstentions, the DARTIC declined to list PFDA and its salts for male reproductive toxicity.

UPDATE OF THE TITLE 27, CAL. CODE OF REGULATIONS, SECTION 27000 LIST OF CHEMICALS WHICH HAVE NOT BEEN ADEQUATELY TESTED AS REQUIRED

The DARTIC voted unanimously to update the Cal., Code of Regs.,Title 27, section 27000 List of Chemicals Which Have Not Been Adequately Tested as Required, based on recommendations in the OEHHA staff report on this agenda item. That report included information provided to OEHHA by the California Department of Pesticide Regulation and the US Environmental Protection Agency on chemicals that they no longer required to be tested.

STAFF UPDATES

OEHHA staff updated the DARTIC on activities since their last meeting (December 2020) related to chemical listings under Proposition 65, proposed or adopted of Safe Harbor Levels and other regulations, and Proposition 65 litigation.
