Oct 22, 2018: Notice of Modification to Text Proposed Amendments to Article 6 Clear and Reasonable Warnings Residential Rental Property Exposure Warnings New Sections 25607.34 and 25607.35

OEHHA is requesting comments on the modifications to the regulatory text.  In order to be considered, OEHHA must receive comments by 5:00 p.m. on November 7, 2018, the designated close of the comment period.  All comments will be posted on the OEHHA website at the close of the public comment period.

Oct 19, 2018: Notice of Public Hearing and Extension of Public Comment Period on Proposed Amendment to Sections 25821(a) and (c) Level of Exposure to Chemicals Causing Reproductive Toxicity: Calculating Intake by the Average Consumer of a Product

OEHHA is extending the public comment period on this proposed amendment to 5:00 pm, Monday, November 26, 2018 and has scheduled a public hearing on Monday, November 19, 2018.

Oct 5, 2018: Notice of Intent to list Bevacizumab

The California Environmental Protection Agency’s Office of Environmental Health Hazard Assessment (OEHHA) intends to list bevacizumab as known to the state to cause reproductive toxicity (developmental and female endpoints) under the Safe Drinking Water and Toxic Enforcement Act of 198.

Oct 5, 2018: Proposed Amendment to Sections 25821(a) and (c) Level of Exposure to Chemicals Causing Reproductive Toxicity: Calculating Intake by the Average Consumer of a Product

This proposed regulatory action would amend subsection (a) to clarify that where a business presents evidence for the “level in question” of a chemical listed as causing reproductive toxicity in a food product based on the average of multiple samples of that food, the level in question may not be calculated by averaging the concentration of the chemical in food products from different manufacturers or producers, or that were manufactured in different facilities from the product at issue.

Sep 28, 2018: Notice of Proposed Rulemaking: Title 27, California Code of Regulations - Amendment to Section 25805 Specific Regulatory Levels: Chemicals Causing Reproductive Toxicity n-Hexane

Proposal to adopt Proposition 65 Maximum Allowable Dose Levels (MADLs) for n-hexane. The proposed oral MADL for n-hexane is 28,000 micrograms per day and the proposed inhalation MADL for n-hexane is 20,000 micrograms per day.

Aug 17, 2018: Acceptance of a Request for a Safe Use Determination for Styrene in Fiber Care Baths, Inc. Bathware Products Manufactured Utilizing 1st and 2nd Laminations Systems and LV-9800 Acrylated Gel-Coat and Opportunity for Public Comment

This SUD request is limited to exposures to styrene from Fiber Care Baths, Inc. bathware products manufactured utilizing 1st and 2nd laminations systems and application of the LV-9800 acrylated gel-coat.  Exposure to other listed substances, if any, which may be present in these materials will not be reviewed by OEHHA in the context of this request.

Aug 17, 2018: Announcement of the Carcinogen Identification Committee Meeting Scheduled for November 1, 2018 and Availability of Hazard Identification Materials for N-Nitrosohexamethyleneimine and Gentian Violet

N-Nitrosohexamethyleneimine and gentian violet will be considered for possible listing by the CIC at a public meeting scheduled for Thursday, November 1, 2018.  The meeting will be held in the Sierra Hearing Room at the CalEPA Headquarters building, 1001 I Street, Sacramento, California.  The meeting will begin at 10:00 a.m. and will last until all business is conducted or until 5:00 p.m.  The agenda for the meeting will be provided in a future public notice published in advance of the meeting.

Aug 9, 2018: New Section 25501.1 Naturally Occurring Concentrations of Listed Chemicals in Unprocessed Foods; Inorganic Arsenic in White and Brown Rice

This provides guidance for businesses and the public by establishing default natural background levels for inorganic arsenic in white and brown rice.  These default background levels can assist businesses in determining the applicability of the warning requirements of Proposition 65.

Aug 3, 2018: Notice of Intent to Modify a Listing by the Labor Code Mechanism: Alcoholic Beverages

The California Environmental Protection Agency’s Office of Environmental Health Hazard Assessment (OEHHA) intends to modify the listing of alcoholic beverages as shown in the table below as known to the state to cause cancer under the Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65).  This action is being taken pursuant to the “Labor Code” listing mechanism.

Jul 27, 2018: Announcement of the Developmental and Reproductive Toxicant Identification Committee Meeting Scheduled For October 11, 2018 and Availability of Hazard Identification Materials for Nickel and Nickel Compounds

Nickel and nickel compounds will be considered for possible listing by the Developmental and Reproductive Toxicant Identification Committee. The meeting will be held in the Sierra Hearing Room at the CalEPA Headquarters building, 1001 I Street, Sacramento, California.  The meeting will begin at 10 a.m. and will last until all business is conducted or until 5:00 p.m.

Jul 25, 2018: Amendment to Section 25805 Maximum Allowable Dose Level – Metham Sodium

This regulation establishes a MADL of 290 micrograms per day for metham sodium.  

Jun 15, 2018: Proposed OEHHA regulation clarifies that cancer warnings are not required for coffee under Proposition 65

The proposed regulation would state that drinking coffee does not pose a significant cancer risk, despite the presence of chemicals created during the roasting and brewing process that are listed under Proposition 65 as known carcinogens.

Jun 15, 2018: Proposed Adoption of New Section Under Article 7 No Significant Risk Levels Section 25704 Exposures to Listed Chemicals in Coffee Posing No Significant Risk

A public hearing will be held on August 16, 2018, at which time any person may make comments orally or in writing on the proposed action described in this notice. 

May 30, 2018: Extension of Comment Period and Notice of Public Hearing – Proposed Amendment to Article 6 – Clear and Reasonable Warnings – Consumer Product Exposure Warnings Pesticides

The comment period will be extended to on this proposed amendment has been extended to 5:00 pm, Thursday, July 5, 2018.

May 25, 2018: Chemical Listed Effective May 25, 2018 as Known to the State of California to Cause Cancer: TRIM® VX

The listing of TRIM® VX is based on formal identification by the National Toxicology Program (NTP), an authoritative body, that the chemical causes cancer.  The criteria used by OEHHA for the listing of chemicals under the “authoritative bodies” mechanism can be found in Title 27, Cal. Code of Regs., section 25306.

May 17, 2018: Notice of Amendment to Section 25705 no Significant Risk Level for Vinylidene Chloride

The regulation will be effective on July 1, 2018.  This regulation establishes a No Significant Risk Level of 0.88 micrograms per day for vinylidene chloride for purposes of Proposition 65.
