Proposition 65

Proposition 65, officially known as the Safe Drinking Water and Toxic Enforcement Act of 1986, was enacted as a ballot initiative in November 1986. The law protects the state's drinking water sources from being contaminated with chemicals known to cause cancer, birth defects or other reproductive harm, and requires businesses to inform Californians about exposures to such chemicals.

Proposition 65 requires the state to maintain and update the list of chemicals subject to the law’s requirements.

November 1, 2019: Notice Of Extension Of The Public Comment Period For The Proposed Rulemaking For p‑Chloro-α,α,α-trifluorotoluene (PCBTF) Proposed Amendments To Sections 25705 No Significant Risk Level

At the request of the American Coatings Association, OEHHA hereby extends the public comment period. The comment period will now close on Tuesday, December 17, 2019.

October 18, 2019: Notice of Proposed Rulemaking Title 27, California Code of Regulations Amendment to Section 25705 Specific Regulatory Levels Posing No Significant Risk: P-Chloro-α,α,α-Trifluorotoluene (PCBTF)

This notice will also open a comment period that is designated to close on December 2, 2019. A public hearing on this proposed regulatory amendment will be scheduled on request.

October 4, 2019: Notice of Modification to Text of Proposed Regulation Title 27, California Code of Regulations Proposed Amendment to Section 25600.2 Responsibility to Provide Consumer Product Exposure Warnings

The Office of Environmental Health Hazard Assessment is providing notice of changes to the proposed regulatory action to amend Section 25600.2 of Title 27 of the California Code of Regulations. Section 25600.2 addresses the responsibility to provide consumer product exposure warnings for chemicals listed under Proposition 65.

September 20, 2019: Announcement of the Carcinogen Identification Committee Meeting Scheduled for December 5, 2019, Notice of Availability of Hazard Identification Materials for Acetaminophen and Notice of Public Comment Period

Acetaminophen will be considered for possible listing by the Committee at a public meeting scheduled for Wednesday, December 5, 2019. The meeting will be held in the Sierra Hearing Room at the CalEPA Headquarters building, 1001 I Street, Sacramento, California.

September 19, 2019: Withdrawal of Notice of Proposed Proposition 65 Rulemaking, Title 27, Cal Code of Regs, Section 25821 (a) and (c)

On October 5, 2018, the Office of Environmental Health Hazard Assessment (OEHHA) issued a notice of proposed rulemaking to adopt amendments to Title 27, California Code of Regulations, section 25821. The amendments were intended to clarify when and how a person could average concentrations of a listed chemical in a food, and identified the use of the arithmetic mean as the default method of calculation of individual exposure.
