This is the comment period on OEHHA's proposal to amend Section 25903(b)(2)(E) and Appendix A of Title 27 of the California Code of Regulations to clarify the content required in notices of violation served on alleged violators of Proposition 65.
The California Environmental Protection Agency’s Office of Environmental Health Hazard Assessment (OEHHA) is the lead agency for the implementation of the Safe Drinking Water and Toxic Enforcement Act of 1986 (commonly known as Proposition 65, codified at Health and Safety Code section 25249.5 et seq.).
OEHHA is requesting public comments on the Notice of Intent to List pentabromodiphenyl ether mixture [DE-71 (technical grade)] as known to the State to cause cancer under Proposition 65 via the authoritative bodies listing mechanism.

The California Environmental Protection Agency’s Office of Environmental Health Hazard Assessment (OEHHA) is the lead agency for the implementation of Proposition 65[1]. The Carcinogen Identification Committee (CIC) of OEHHA’s Science Advisory Board serves as the state’s qualified experts and renders an opinion about whether a chemical has been clearly shown to cause cancer[2]. The chemicals identified by the CIC are added to the Proposition 65 list.
