On November 19, 2014, the Office of Administrative Law approved an amendment to Title 27, California Code of Regulations, section 25903, Appendix A. This regulatory amendment provides an update to the existing regulatory summary of Proposition 65 that must be included as an attachment to all notices of violation that are served upon alleged violators of Proposition 65. This amendment also reconciles OEHHA’s regulations with a 2013 amendment to Proposition 65 due to the enactment of AB 227 (Gatto, Chapter 581, Statutes of 2013).

This regulatory action adds a section to the existing Proposition 65 implementing regulations that sets forth the criteria for listing chemicals by reference to Labor Code section 6382(b)(1), as required under Health and Safety Code section 25249.8(a).
