The Carcinogen Identification Committee (CIC) declined to list bisphenol A as a carcinogen under Proposition 65 by a vote of 5 (yes) to 6 (no). A recording of the full meeting and transcript is available online.


A meeting of the CIC was held virtually on December 14, 2022, starting at 10:00 am. During the meeting, OEHHA staff presented a summary of evidence on the carcinogenicity of bisphenol A (BPA). The CIC considered listing BPA as a carcinogen under Proposition 65 and declined to list this chemical by a vote of 5 (yes) to 6 (no). Ahead of the meeting, OEHHA had issued a request for relevant information on the potential carcinogenicity of BPA, which opened on January 28, 2022 and closed on March 14, 2022. The data call-in was followed by publication of the hazard identification document entitled “Evidence on the Carcinogenicity of Bisphenol A” and a public comment period from September 30, 2022 to November 14, 2022. 

At the meeting, the CIC also voted 10 — 0, with one abstention, in favor of the consent item to remove bromadiolone from the list of chemicals for which testing is required but has been inadequate (California Code of Regulations (CCR) Title 27 Section 27000). As described in the OEHHA staff report, data requirements for bromadiolone have been fulfilled. This list of chemicals is distinct from the Proposition 65 list.

Finally, OEHHA staff presented updates on chemical listing via the administrative listing mechanisms, safe harbor levels, and other regulations and litigation from the past year.

OEHHA was pleased to swear in two new members of the CIC, Dr. Sophia Wang, professor at City of Hope National Medical Center and Dr. Ahmad Besaratinia, professor of research population and public health sciences at the University of Southern California, Keck School of Medicine. Both were appointed to the CIC by the Governor in 2022. OEHHA and the committee also recognized Dr. Thomas Mack, who served as the esteemed chair of the CIC for nearly 30 years before announcing his retirement from the committee at this meeting.
