The Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65 or the Act), which is codified as Health and Safety Code section 25249.5 et seq., requires the Governor to publish, and update at least annually, a list of chemicals known to the State to cause cancer or reproductive toxicity. The Act describes the mechanisms for administratively listing chemicals as known to the State to cause cancer or reproductive toxicity (Health and Safety Code section 25249.8).

The California Environmental Protection Agency’s Office of Environmental Health Hazard Assessment (OEHHA) intends to list the chemicals diclofop-methyl and epoxiconazole as known to the State to cause cancer under the Safe Drinking Water and Toxic Enforcement Act of 1986. This action is being taken under the authoritative bodies listing mechanism.

On September 23, 2011, OEHHA published a notice in the California Regulatory Notice Register (Register 2011, No. 38-Z) proposing to establish a specific regulatory level posing no significant risk for Imazalil by amending Title 27, California Code of Regulations, section 25705.
