Nov 22, 2019: Carcinogen Identification Meeting Postponed and Announcement of Additional Public Comment Period

The public comment period will commence on November 29, 2019 and end on January 27, 2020.  All comments received will be provided to the committee for their consideration. The CIC meeting will be rescheduled after the close of the public comment period.

Nov 15, 2019: Issuance of Safe Use Determinations and Interpretive Guidelines for Chlorothalonil Residues in Certain Foods Resulting from Pesticidal Use of the Chemical

OEHHA is issuing the following SUDs to Syngenta Crop Protection, LLC for chlorothalonil exposures resulting from consumption of residues in certain foods, as specified below.

Nov 1, 2019: Notice Of Extension Of The Public Comment Period For The Proposed Rulemaking For p‑Chloro-α,α,α-trifluorotoluene (PCBTF) Proposed Amendments To Sections 25705 No Significant Risk Level

At the request of the American Coatings Association, OEHHA hereby extends the public comment period.  The comment period will now close on Tuesday, December 17, 2019.

Oct 18, 2019: Notice of Proposed Rulemaking Title 27, California Code of Regulations Amendment to Section 25705 Specific Regulatory Levels Posing No Significant Risk: P-Chloro-α,α,α-Trifluorotoluene (PCBTF)

This notice will also open a comment period that is designated to close on December 2, 2019. A public hearing on this proposed regulatory amendment will be scheduled on request.

Oct 4, 2019: Notice of Modification to Text of Proposed Regulation Title 27, California Code of Regulations Proposed Amendment to Section 25600.2 Responsibility to Provide Consumer Product Exposure Warnings

The Office of Environmental Health Hazard Assessment is providing notice of changes to the proposed regulatory action to amend Section 25600.2 of Title 27 of the California Code of Regulations.  Section 25600.2 addresses the responsibility to provide consumer product exposure warnings for chemicals listed under Proposition 65.

Sep 20, 2019: Announcement of the Carcinogen Identification Committee Meeting Scheduled for December 5, 2019, Notice of Availability of Hazard Identification Materials for Acetaminophen and Notice of Public Comment Period

Acetaminophen will be considered for possible listing by the Committee at a public meeting scheduled for Wednesday, December 5, 2019. The meeting will be held in the Sierra Hearing Room at the CalEPA Headquarters building, 1001 I Street, Sacramento, California.

Sep 19, 2019: Withdrawal of Notice of Proposed Proposition 65 Rulemaking, Title 27, Cal Code of Regs, Section 25821 (a) and (c)

On October 5, 2018, the Office of Environmental Health Hazard Assessment (OEHHA) issued a notice of proposed rulemaking to adopt amendments to Title 27, California Code of Regulations, section 25821.  The amendments were intended to clarify when and how a person could average concentrations of a listed chemical in a food, and identified the use of the arithmetic mean as the default method of calculation of individual exposure. 

Sep 13, 2019: Chemicals Listed Effective September 13, 2019 as Known to The State of California to Cause Cancer: 2-Amino-4-Chlorophenol; 2-Chloronitrobenzene; 1,4-Dichloro-2-Nitrobenzene; 2,4-Dichloro-1-Nitrobenzene; N,N-Dimethylacetamide, and Para-Nitroanisole

The chemicals are being added to the list of chemicals known to the State of California to cause cancer for purposes of Proposition 65. The listing of these chemicals is pursuant to the “Labor Code” listing mechanism.

Aug 12, 2019: OEHHA Statement Regarding US EPA’s Press Release and Registrant Letter on Glyphosate

OEHHA added glyphosate to the Proposition 65 list of carcinogens in July 2017, based on a finding by the World Health Organization’s International Agency for Research on Cancer (IARC) that glyphosate is both an animal carcinogen and “probably carcinogenic to humans”.

Jul 16, 2019: Notice of Amendments to Article 6 Clear and Reasonable Warnings Rental Vehicle Exposure Warnings

This rulemaking adds Sections 25607.36 and 25607.37 to Article 6 as safe harbor tailored warnings for exposures to listed chemicals that may occur through the rental of a motor vehicle.

Jul 12, 2019: Notice of Intent to List: 2-Amino-4-chlorophenol, 2-Chloronitrobenzene, 1,4-Dichloro-2-nitrobenzene, 2,4-Dichloro-1-nitrobenzene, N,N-Dimethylacetamide, and para-Nitroanisole

OEHHA intends to list the following chemicals as known to the state to cause cancer under the Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65).  This action is being proposed pursuant to the “Labor Code” listing mechanism.  OEHHA has determined that 2-Amino-4-chlorophenol, 2-Chloronitrobenzene, 1,4-Dichloro-2-nitrobenzene, 2,4-Dichloro-1-nitrobenzene, N,N-Dimethylacetamide, and para-Nitroanisole meet the criteria for listing as known to cause cancer by this mechanism. OEHHA is providing an opportunity to comment, and comments must be received by Monday, August 12, 2019 to be considered. Additional information can be found in the listing notice.

Jul 12, 2019: Notice of Extension of Comment Period for Modification to Text of Proposed Regulation: Proposed Amendment to Sections 25821(a) and (c) Level of Exposure to Chemicals Causing Reproductive Toxicity: Calculating Intake by the Average Consumer of a Product

OEHHA is requesting comments on the modifications to the regulatory text.  In order to be considered, OEHHA must receive comments by August 5, 2019, which is the designated close of the comment period.  All comments will be posted on the OEHHA website at the close of the public comment period.

Jun 28, 2019: Chemical Listed Effective June 28, 2019 as Known to the State Of California To Cause Cancer: P-Chloro-a,a,a-Trifluorotoluene (Para-Chlorobenzotrifluoride, PCBTF)

The listing of p-chloro-α,α,α-trifluorotoluene is based on formal identification by the National Toxicology Program (NTP), an authoritative body, that the chemical causes cancer.

Jun 7, 2019: Notice of Adoption – Section 25704 Exposures to Listed Chemicals in Coffee Posing No Significant Risk

On June 3, 2019, the Office of Administrative Law approved the adoption of Title 27, California Code of Regulations, section 25704, Exposures to Listed Chemicals in Coffee Posing No Significant Risk.

May 24, 2019: Amendment to Section 25805 Specific Regulatory Levels: Chemicals Causing Reproductive Toxicity Maximum Allowable Dose Levels For Chlorpyrifos (Oral, Inhalation And Dermal Exposures)

Office of Environmental Health Hazard Assessment (OEHHA) proposes to establish three Proposition 65[1] Maximum Allowable Dose Levels (MADLs) for exposure to chlorpyrifos by amending Section 25805(b) of Title 27 of the California Code of Regulations.

May 2, 2019: Proposition 65 Definition of Nickel (Soluble Compounds)

For purposes of Proposition 65, Nickel (soluble compounds) are defined to be compounds of nickel with solubility in water of greater than 0.1 moles per liter (mol/L) at 20oC.

Apr 8, 2019: Acetaminophen Selected by OEHHA for Consideration for Listing by the Carcinogen Identification Committee and Request for Relevant Information on the Carcinogenic Hazard of this Chemical

The Carcinogen Identification Committee of OEHHA’s Science Advisory Board serves as the state’s qualified experts and renders an opinion about whether a chemical has been clearly shown to cause cancer.  The chemicals identified as carcinogens by the CIC are added to the Proposition 65 list. 

Mar 21, 2019: Notice of Amendment to Article 6, Clear and Reasonable Warnings Residential Rental Property Exposure Warnings

This rulemaking adds Sections 25607.34 and 25607.35 to Article 6 as safe harbor, tailored warnings for exposures to listed chemicals that may occur at residential rental properties. 

Mar 21, 2019: Amendment to Section 25805 Maximum Allowable Dose Levels for n-Hexane (Oral and Inhalation)

This amendment establishes an oral MADL of 28,000 micrograms per day and an inhalation MADL of 20,000 micrograms per day for n-hexane.
