Notice of Adoption to Text of Regulations Title 22, California Code of Regulations Amendment to Section 12805 Maximum Allowable Dose Levels (MADLs) for Di(2-ethylhexyl)phthalate (by Intravenous Injection)
On October 29, 2004, The Office of Environmental Health Hazard Assessment issued a Notice of Proposed Rulemaking announcing the proposed adoption of the Maximum Allowable Dose Level (MADL) for the chemical Di(2-ethylhexyl)phthalate (DEHP) by intravenous injection and amend Title 22, California Code of Regulations, Section 12805 (22 CCR Section 12805). A public hearing was held on December 13, 2004. Written and oral testimony were accepted at the hearing. Written comments were also received during the 45-day comment period which was originally closed on December 13, 2004. After reviewing the comments received, OEHHA revised the originally proposed regulatory text and published the modification notice in the California Regulatory Notice Register (CRNR) on June 24, 2005 and posted on the OEHHA website on the same day. The modification notice proposed to establish three MADLs for DEHP, specifically for exposure via the intravenous injection for adults, infant boys and neonatal boys and announced a second 45-day comment period which closed on August 8, 2005. A second public hearing on the modification to the originally proposed regulatory text was held on August 8, 2005 to receive written and oral testimony. Written comments were received during the second 45-day comment period. On August 17, 2005, OEHHA issued a Notice of Addition of Documents and Information to the Rulemaking File and announced a 15-day comment period which closed on September 1, 2005. On March 3, 2006, OEHHA issued a Notice of Modifications to Text of Proposed Regulations to address issues raised by the Office of Administrative Law (OAL) and a second Notice of Addition of Documents and Information to Rulemaking File. Each March 3 notice announced a 15-day comment period which closed on March 20, 2006. OAL approved the adoption of the MADLs for DEHP for exposure via intravenous injection and the amendment to Title 22, California Code of Regulations, Section 12805 on May 19, 2006. The regulation was filed with the Secretary of State on May 19, 2006 and became effective June 19, 2006.
