Status Report on Chemicals Subject to July 16, 1999 Public Notice and Extension on Request for Information for sodium nitrite (CAS No. 007632-00-0) and triphenyltin hydroxide (CAS No. 000076-87-9)

Chemicals to be Considered by OEHHA’s Science Advisory Board's Developmental and Reproductive Toxicant (DART) Identification Committee

The California Environmental Protection Agency’s Office of Environmental Health Hazard Assessment (OEHHA) is the lead agency for the implementation of the Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65). The Developmental and Reproductive Toxicant (DART) Identification Committee of OEHHA’s Science Advisory Board advises and assists OEHHA in compiling the list of chemicals known to the State to cause reproductive toxicity, which is mandated by Health and Safety Code Section 25249.8. The Committee serves as the State’s qualified experts for rendering an opinion whether a chemical has been clearly shown through scientifically valid testing according to generally accepted principles to cause reproductive toxicity.

On July 16, 1999, OEHHA published a public notice in the California Regulatory Notice Register (CRNR) (Register 99, No. 29-Z) requesting information relevant to the assessment of the reproductive and developmental toxicity of: 2,4-D 2-ethylhexyl ester, 2,4-D 2-ethyl-4-methylpentyl ester, fenbutatin oxide, propachlor, quizalofop-ethyl, sodium nitrite, and triphenyltin hydroxide. In accordance with OEHHA’s process for preparing information on candidate chemicals for review by the State’s qualified experts, OEHHA reviews the available literature and data on the candidate chemicals, including that information submitted by interested parties and develops a hazard identification document for each chemical based on the evidence of reproductive toxicity for the chemical.

The public notice published in the CRNR on July 16, 1999 stated that 2,4-D 2-ethylhexyl ester and 2,4-D 2-ethyl-4-methylpentyl ester are individual isooctyl esters of 2,4-D, and that 2,4-D isooctyl ester has been noticed as being under consideration for administrative listing under Proposition 65 (CRNR, August 22, 1997, Register 97, No. 34-Z). If 2,4-D isooctyl ester is listed under Proposition 65 as causing reproductive toxicity, 2,4-D 2-ethylhexyl ester and 2,4-D 2-ethyl-4-methyl-pentyl ester may or may not be considered by the DART Identification Committee. Although preparation of hazard identification documents for these two chemicals will not begin until this is resolved, a request for information was made in the event documents are prepared. If hazard identification documents are prepared for 2,4-D 2-ethylhexyl ester and 2,4-D 2-ethyl-4-methylpentyl ester, a second data call-in period will be announced so that the most recent relevant information may be submitted.

Preparation of the hazard identification document for propachlor is pending receipt of studies provided to the U.S. Environmental Protection Agency in support of propachlor’s federal pesticide registration. Because of the probable delay in preparation of the hazard identification document on propachlor, a second data call-in period will be announced when preparation of the document is initiated.

Preparation of the hazard identification documents for fenbutatin oxide and quizalofop-ethyl is underway. OEHHA anticipates completion and public release for comment of the hazard identification documents for these two chemicals in the Fall of 1999 so that the two candidate chemicals may be brought before the DART Identification Committee for consideration for listing at its meeting on December 13, 1999. The time and location of the meeting have not yet been determined, but will be provided in a future public notice.

In the initial stages of preparing hazard identification documents for sodium nitrite and triphenyltin hydroxide, OEHHA staff determined that additional time is needed to fully review and consider the complex issues regarding these two chemicals. In addition, OEHHA received requests to extend the request for information period for sodium nitrite. Since we anticipate that both chemicals will be brought before the DART Identification Committee for consideration at a meeting in early 2000, instead of December 13, 1999, OEHHA is extending the request for information period for sodium nitrite and triphenyltin hydroxide to September 15, 1999.

Notification of the availability of the individual draft hazard identification documents and of the time, date, location, and agenda of the meetings of the DART Identification Committee where the chemicals will be considered will be provided in future notices published in the California Regulatory Notice Register and posted on OEHHA’s website. The draft hazard identification documents will be made available for public comment prior to the committee meeting at which the chemical is considered.
