Comment Period - Notice of Modification of Proposed Regulation Title 27, California Code of Regulations, Amendment to Section 25705 - Specific Regulatory Levels Posing No Significant Risk: Chlorothalonil

The Office of Environmental Health Hazard Assessment (OEHHA) is providing notice of a change to a proposed regulation establishing a No Significant Risk Level (NSRL) for chlorothalonil in Title 27, California Code of Regulations, section 25705., This proposed regulatory action is being taken pursuant to OEHHA’s authority under Proposition 65.

The proposed NSRL published on March 18, 2011, for chlorothalonil has been changed to 41 micrograms per day.  A copy of the text of the amended proposed regulation is attached.  The changes are shown in double-underline and double-strike-out.  The change has been made because OEHHA used a more current calculation to convert estimates of animal cancer potency to estimates of human cancer potency.  This proposed regulation was originally the subject of a Notice of Proposed Rulemaking, published on March 18, 2011.  Responses to written comments from the current and prior comment periods will be provided in the final statement of reasons for this rulemaking.

A copy of the text of the amended proposed regulation and a modified technical support document presenting the updated calculations used to convert estimates of animal cancer potency to estimates of human cancer potency are available on the OEHHA website at www.oehha.ca.gov.  Copies of these two documents and the comments received during the previous comment period are available from Sam Delson at (916) 327-3015 or sam.delson@oehha.ca.gov.

OEHHA will accept written comments on this amendment to the proposed regulation between January 13, 2012, and January 30, 2012.  All written comments must be submitted to OEHHA by mail, fax, courier, e-mail, or hand-delivery by no later than 5:00 p.m. on January 30, 2012.
