Response to Petition from Physicians Committee for Responsible Medicine to List "Processed Meat" Under Proposition 65

On May 22, 2017, the Physicians Committee for Responsible Medicine submitted an informal petition pursuant to Government Code section 11340.6 and California Code of Regulations, title 27, section 25904(d)[1], to amend California Code of Regulations, title 27, section 27001(b) to add "Processed meat (consumption of)" to the list of chemicals known to the state to cause cancer via the Labor Code listing mechanism.

On March 12, 2020, the Office of Environmental Health Hazard Assessment declined to list “Processed meat (consumption of)” under Proposition 65. The reasons for the decision are set out in OEHHA’s response letter to the Physicians Committee for Responsible Medicine.

Footnotes and References

[1] Government Code section 11340.6 is inapplicable to Proposition 65 listings.  The statute expressly states that listing are not subject to the Administrative Procedure Act (Health and Safety Code section 25449.8(e), therefore OEHHA considers this petition to be an informal request.
