Notice of Adoption to Text of Regulations, Title 22, California Code of Regulations New Section 12900

On February 18, 2005, the Office of Environmental Health Hazard Assessment (OEHHA) issued a Notice of Proposed Rulemaking announcing proposed adoption of new Section 12900 to the Title 22, California Code of Regulations (22 CCR). A public hearing was held on April 4, 2005. Written and oral testimony were accepted at the hearing. Written comments were also received during the 45 day public comment period, which was originally to close on April 4, 2005, but was extended until April 18, 2005. An extension notice was posted on April 6, 2005. The proposed regulatory text was modified on three separate occasions. The first modification notice was posted on July 8, 2005 for a second 45-day comment period that closed on August 22, 2005. The second modification notice was posted on October 28, 2005 for a 15-day comment period that closed on November 14, 2005. The third modification notice was posted on December 16, 2005 for a second 15-day comment period that closed on January 9, 2006. Written comments were received during each of the comment periods. Responses to comments are provided within the final statement of reasons and the addendum to the final statement of reasons. The Office of Administrative Law approved the adoption of the regulation on March 9, 2006. The regulation was filed with the Secretary of State on March 9, 2006 and will be effective on April 8, 2006.
