Availability of the Revised Draft Prioritization Process Document for Additional Public Review and Comment

On May 28, 2004, the Office of Environmental Health Hazard Assessment (OEHHA) published a public notice in the California Regulatory Notice Register (Register 2004, No. 22-Z) announcing the availability of the draft prioritization process document used by OEHHA in selecting chemicals to be reviewed by the state’s qualified experts for possible listing under Proposition 65 (The Safe Drinking Water and Toxic Enforcement Act of 1986, codified at Health and Safety Code section 25249.5) and a 30-day public review and comment period. The public workshop was held on June 16, 2004, in Oakland, California. Oral and written comments were received during the 30-day comment period and at the workshop and the draft document has been revised based on those comments and input from a subcommittee of the Carcinogen Identification Committee (CIC) and Developmental and Reproductive Toxicant (DART) Identification Committees.

Although the discretion to modify or adopt this or any other internal management procedure remains with the Director, OEHHA is seeking public comment on the proposed revisions to the draft prioritization process. The prioritization process does not have the force or effect of law or regulation and is not subject to the requirements of the Administrative Procedure Act (see Health and Safety Code section 25249.8(e)).

This notice announces the availability of the revised draft prioritization process document and initiates a second 30-day public review and comment period prior to the review of the draft document by the CIC at its meeting on November 1, 2004 and the DART Identification Committee at its meeting on November 4, 2004. All comments received during this public comment period will be indexed and forwarded to the CIC and DART Identification Committee in advance of its respective November meeting. OEHHA will not separately respond to the public comments.

In order to be considered, comments must be postmarked (if sent by mail) or received at OEHHA (if hand-delivered, sent by FAX, or transmitted electronically) by 5:00 p.m. on Monday, October 4, 2004.
