Extension of Comment Period - Proposed Listing of Thiabendazole
The Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65) requires the Governor to publish, and update at least annually, a list of chemicals known to the State to cause cancer or reproductive toxicity. The Office of Environmental Health Hazard Assessment (OEHHA) is the lead agency for the implementation of Proposition 65.
On May 14, 1999, OEHHA published a notice in the California Regulatory Notice Register (Register 99, No. 20-Z) announcing its intent to list thiabendazole under Proposition 65 in accordance with the regulatory criteria in Section 12306 of Title 22 of the California Code of Regulations. The publication of the notice initiated a 30-day public comment period which would have closed on June 14, 1999. OEHHA has received requests from interested parties seeking an extension of the comment period to allow for the submittal of complete and relevant scientific information. The extension request is based on the delayed receipt of OEHHA’s response to comments from the data call-in phase. Although OEHHA does not believe the delayed response to comments materially affects the interested parties’ ability to comment during the notice of intent to list phase, OEHHA will establish methods to insure timely and documented receipt of our responses. OEHHA hereby extends the public comment period to 5 p.m., Monday, June 28, 1999.
OEHHA notes that this extension of the 30-day public comment period does not affect the 60-day period that OEHHA is required to wait from publication of the notice of intent to list a chemical until actual listing of a chemical. Accordingly, OEHHA may still list the affected chemical on the Proposition 65 list on or after July 13, 1999.
