Chemicals Listed Effective January 29, 1999 as Known to the State to Cause Cancer or Reproductive Toxicity: 14 Chemicals

The Office of Environmental Health Hazard Assessment (OEHHA) of the California Environmental Protection Agency has added 14 chemicals named below to the list of chemicals known to the State to cause cancer or reproductive toxicity, for purposes of the Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65 or the Act). These chemicals are listed effective January 29, 1999.

Two chemicals, 2-aminofluorene and 4-amino-2-nitrophenol, are listed as carcinogens based upon a formal opinion of the OEHHA Science Advisory Board’s Carcinogen Identification Committee. At its December 10, 1998 meeting, the Committee determined that 2-aminofluorene and 4-amino-2-nitrophenol were found to have been clearly shown through scientifically valid testing according to generally accepted principles to cause cancer. The listing mechanism of the Science Advisory Board’s Carcinogen Identification Committee is addressed in Title 22, California Code of Regulations, Section 12306.

The reader is directed to the Notice to Interested Parties of the "December 10, 1998 Meeting of the Science Advisory Board’s Carcinogen Identification Committee" published in the October 30, 1998 issue of the California Regulatory Notice Register for the supporting documentation which the Committee relied upon in making its determination that 2-aminofluorene and 4-amino-2-nitrophenol have been clearly shown to cause cancer.

The other 12 chemicals are listed pursuant to an administrative mechanism provided under the Act, based upon a formal requirement by a state or federal agency that the chemical be identified or labeled as causing cancer or reproductive toxicity. Regulations governing the listing of chemicals under the "formally required to be labeled or identified" mechanism are published in Title 22, California Code of Regulations, Section 12902.

The reader is directed to the Notice of Intent to List Chemicals published in the November 27, 1998 issue of the California Regulatory Notice Register for the supporting documentation which OEHHA relied upon in making its determination that the criteria for administrative listing have been satisfied.
